Acceptance of These Terms
By accessing or using UMBRAL — this website and all content, services, and digital products offered through it — you agree to be bound by these Terms of Use. If you do not agree, please do not use the site. These Terms apply to all visitors, whether or not you make a purchase, subscribe, register, or donate.
About UMBRAL and Creative Authorship
UMBRAL is the digital sanctuary of the artist, writer, and musician Adriana Gaïan. Every creative work presented here — poems, lyrics, musical compositions, visual art, booklets, the magazine, the Daily Ledger of Awakening, letters, readings, and reflections — is the intellectual property of ADRIANA GAÏAN under Umbral Artwork INC. Adriana is creatively involved in every work published on this site: she conceives, directs, selects, edits, and refines each piece, and the final published expression reflects her authorship and creative intent.
Use of Artificial Intelligence — Full Disclosure
Honesty is part of this sanctuary. Some works on UMBRAL are entirely original, written by hand by Adriana Gaïan. Other works are created with the assistance of artificial intelligence (AI) tools that Adriana directs through prompts, then selects, edits, and refines to their final form. Not all content is AI-generated, and no work is published without Adriana's creative involvement and judgment. Where a specific work materially relies on AI — for example, a musical composition featuring AI-generated voice or instrumentation — that contribution is disclosed with the work. We do not represent any work as wholly human-authored when AI tools contributed to its creation. If you have questions about how a particular piece was made, you are welcome to contact us.
Copyright and Ownership
All content on UMBRAL — including text, poetry, lyrics, music, images, artwork, design, and code — is protected by copyright and other intellectual-property laws. © ADRIANA GAÏAN — Umbral Artwork INC. All rights reserved. Unauthorized copying, reproduction, distribution, public performance, or derivative use is prohibited.
License Granted With a Purchase
Purchasing a poem, song, booklet, artwork, or any work on UMBRAL grants you a limited, non-exclusive, non-transferable license for personal, non-commercial use, together with the downloadable file. This license does not transfer ownership or authorship, which remain exclusively with ADRIANA GAÏAN under Umbral Artwork INC.
Permitted and Prohibited Use
You may store and enjoy purchased works privately for your own personal use. Without prior written authorization you may not: copy, share, redistribute, resell, sublicense, publicly perform, or create derivative works; remove watermarks or attribution; use any work commercially; use UMBRAL content to train AI or machine-learning models; or scrape, harvest, or data-mine the site. Commercial use, licensing, reproduction, or affiliation with any work requires prior written authorization from the author.
Watermarking
Artwork and creative content displayed on the site is watermarked to protect authorship. Purchased downloads provide unwatermarked, high-resolution files for your personal enjoyment under the license above.
Purchases, Refunds, and Cancellations
Digital products are delivered immediately upon purchase. Because digital goods are accessed and downloaded instantly, refunds are generally not available once a download has begun, except where required by applicable consumer-protection law or where a product is defective or not delivered as described. If you experience a problem with a purchase, please contact us through our Contact Us page and we will work to resolve it. Your statutory consumer rights remain protected and are not excluded by these Terms.
Subscriptions
Free subscriptions may be cancelled at any time. Paid subscriptions, including The Umbral Circle membership, may be cancelled at any time and remain active until the end of the current billing period; no partial refunds are issued for the remaining period unless required by law. Recurring billing is managed through Stripe and can be cancelled from your account or by contacting us.
Donations
Donations are voluntary personal gifts to support UMBRAL and help keep this site open and growing. They are not payment for goods or services, are not tax-deductible charitable contributions, and UMBRAL is not a registered charity. Donations are processed securely through Stripe, may be made in any amount from $1 upward, and are recorded for internal accounting. Donation refunds are granted at UMBRAL's discretion; contact us for any request.
Privacy and Data Protection
Your email, contact information, and any data you share with UMBRAL are used solely for UMBRAL communication such as receipts, subscriptions, and letters you request. We do not sell your personal data, information, or credentials to anyone, ever. We do not share your personal information with third parties except as necessary to process payments (for example, Stripe) or as required by law. All data transmitted between your device and UMBRAL is encrypted in transit via TLS/HTTPS. All stored data is encrypted at rest by the platform's managed database. Your password is never stored in plain text — it is hashed and salted by the authentication backend before storage. Your location and IP address are never displayed to other users, sold, or shared. When you create an account, your email remains private and is never shown to other members or visitors.
Account Security and Verification
Every account on UMBRAL is protected by multiple layers of security. Passwords must meet a high-entropy policy: at least 12 characters with a mix of uppercase, lowercase, numbers, and special characters. New account registration requires a human-verification CAPTCHA and email confirmation via a one-time code. Free and paid subscriptions, contact-form submissions, and downloads are all gated by CAPTCHA verification to prevent automated abuse. The owner and administrator account is further protected by a secondary second password: when a login is attempted from an unrecognized IP address or device, the second password must be entered before access is granted. Trusted devices are remembered for 90 days; after that, the second password is required again. All IP addresses and device identifiers used for this verification are stored only as one-way HMAC hashes — the raw values are never stored.
Invoices and Receipts
After each purchase or donation you receive a receipt from UMBRAL. For your privacy, invoices display only: the UMBRAL name, the site URL (novaumbral.com), a description of what was purchased or donated, and the amount before and after any applicable taxes. We do not include your full name, company names, card details, or personal contact information on invoices.
Wellness Disclaimer
Adriana Gaïan is an artist, writer, and musician — not a licensed medical, psychological, psychiatric, or healthcare professional. Nothing on UMBRAL — no poem, letter, article, reading, or reflection — is medical, psychological, or psychiatric advice, diagnosis, or treatment. The work here shares one human experience offered as art, for inspiration and encouragement. If you are facing illness, distress, or any condition of body or mind, please seek the care of qualified, licensed practitioners. Their support and this art are companions, not substitutes.
Readings and Spiritual Content
Any tarot, oracle, or spiritual readings offered on UMBRAL are provided for entertainment, reflection, and artistic inspiration only. They are not predictions, professional advice, or a substitute for professional guidance. Each life path and spiritual experience is unique; UMBRAL shares one human journey as inspiration and encouragement, never as a path to imitate.
Limitation of Liability and Disclaimers
UMBRAL and all content are provided 'as is' and 'as available,' without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted or error-free. To the maximum extent permitted by law, ADRIANA GAÏAN and Umbral Artwork INC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the site or its content.
Third-Party Services
Payments are processed by Stripe and other third-party providers whose own terms govern their services. UMBRAL is not responsible for the practices of third-party services beyond the processing of your transaction.
Age Requirement
You must be at least 18 years old, or the age of majority in your jurisdiction, to make purchases or donations on UMBRAL. A parent or guardian may not make purchases on behalf of a minor through this site.
User Conduct and Accounts
If you create an account, you are responsible for safeguarding your credentials and for all activity under your account. You agree not to misuse the site, interfere with its operation, attempt to access content you have not purchased, or introduce malware or harmful code.
Changes to These Terms
We may update these Terms from time to time. The 'Last updated' date shown on this page reflects the most recent revision. Continued use of UMBRAL after any change constitutes acceptance of the updated Terms.
Intellectual Property Infringement Claims
We respect intellectual-property rights. If you believe content on UMBRAL infringes your copyright, please contact us through our Contact Us page with the information required for a takedown notice, and we will investigate promptly.
Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which Umbral Artwork INC is established. We will first attempt to resolve any dispute in good faith through direct communication. Any unresolved dispute shall be brought in the competent courts of that jurisdiction.
